1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Postiz social media scheduling and management platform ("Service"), operated by Montadecs Co., Ltd. ("Company," "we," "us," or "our"), accessible at postiz.imseankim.com. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

Postiz is a social media scheduling and management platform that allows users to connect their social media accounts (including but not limited to TikTok, Instagram, Facebook, X/Twitter, YouTube, and LinkedIn) to schedule, publish, and manage content. The Service may include:

• Scheduling and auto-publishing posts to connected social media platforms
• Content calendar and management tools
• Analytics and performance insights
• Team collaboration features
• AI-assisted content suggestions

5. Third-Party Platform Integration

The Service integrates with third-party social media platforms via their official APIs (e.g., TikTok API, Meta Graph API). By connecting your social media accounts, you authorize us to access and interact with those accounts on your behalf, within the scope of permissions you grant. Your use of third-party platforms remains subject to their respective terms and policies.

We do not control and are not responsible for the availability, accuracy, or policies of third-party platforms. Access to third-party APIs may be modified, limited, or revoked at any time by those platforms.

6. User Content

You retain all ownership rights to content you create, upload, or schedule through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit your User Content solely for the purpose of providing the Service.

You are solely responsible for your User Content and must ensure it complies with applicable laws and third-party platform policies. We reserve the right to remove content that violates these Terms.

7. Prohibited Conduct

You agree not to:

• Use the Service to violate any applicable law or regulation
• Post or distribute harmful, abusive, defamatory, or infringing content
• Attempt to gain unauthorized access to the Service or related systems
• Use automated means to access the Service beyond what we provide
• Interfere with or disrupt the Service or its infrastructure

• Use the Service to spam or send unsolicited messages

8. Intellectual Property

9. Termination

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONTADECS CO., LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Montadecs Co., Ltd. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts in Seoul, Republic of Korea.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
